I hereby affirm that I am of legal age, exceeding eighteen (18) years, and in a sound mental state during the execution of this Waiver, Release, Hold Harmless, and Indemnification Agreement (referred to as "Release"). I willingly consent to the terms outlined below.
CATS & CRYSTALS LLC facilitates feline-related activities, including engaging with specific cats and/or kittens, at its establishment in Oceanside, CA ("Premises"). In exchange for the opportunity to partake in these activities, including interacting with the feline residents, I commit to adhering to the stipulations of this waiver and release.
I am aware of, and fully comprehend the inherent risks involved in engaging with cats and/or kittens, encompassing the potential for damage, personal injury, and even fatality to myself, other individuals, my belongings, and/or others' property. Additionally, I acknowledge that these activities take place in an indoor environment at the Premises, exposing me to potential illness from contagious diseases, such as COVID-19, with the accompanying risks of severe illness and death. I knowingly and voluntarily assume all such risks, including injuries, harm, and losses associated with feline-related activities, including illnesses and contagious diseases like COVID-19, even if resulting from negligence on the part of Cats & Crystals, its staff, or any affiliated entities, including, but not limited to, Today Tomorrow forever Rescue.
With full awareness, I execute this Release, assuming complete and sole responsibility for potential damage, death, personal injury, and/or property loss arising from my participation in activities provided by Cats & Crystals LLC, including any harm and loss caused by negligence, fault, or any form of conduct by Cats & Crystals LLC.
I acknowledge that participants in these activities, including other customers, staff, and involved individuals, may not be covered by Cats & Crystals' insurance, and customers may lack the right to file claims against Cats & Crystals' insurance policy.
I commit to complying with all rules and regulations set forth by Cats & Crystals LLC regarding interactions with cats and/or kittens and my presence at the Premises. I pledge to engage in all activities responsibly. Failure to abide by these rules may lead to Cats & Crystals terminating my participation, and I understand that no refund will be provided.
I recognize that playing with cats and/or kittens may not be supervised continuously, and Cats & Crystals' staff may not be present throughout my interaction with the feline residents. However, staff will remain on the Premises to periodically oversee activities, offer guidance, and assist in case of participant difficulty.
I confirm that I do not have any physical or emotional issues, including allergies, that would hinder my ability to interact with cats and/or kittens safely and appropriately.
I agree not to engage in any activity that may harm or distress the cats and/or kittens in any way.
By signing this Release, I forever discharge Cats & Crystals LLC, Today Tomorrow Forever Rescue, their agents, owners, employees, and independent contractors, along with their sureties, insurers, successors, assigns, and legal representatives ("Indemnified Parties"), from any liability, claims, causes of action, demands, and damages for injury, death, or damages of any kind to myself or my property resulting from my participation in activities at Cats & Crystals, including playing with cats and/or kittens. This includes instances where such injury, death, or property damage is caused by the intentional or negligent acts of other customers of Cats & Crystals, its employees, agents, owners, or independent contractors, or any other individuals at Cats & Crystals. I also agree to cover all attorneys' fees and costs incurred by Cats & Crystals LLC, Today Tomorrow Forever Rescue, and any of their respective agents, employees, owners, and independent contractors if I bring any action, claim, or demand against them for any reason covered by this Release.
I commit to defending with counsel chosen by the Indemnified Party, indemnifying, and holding harmless Cats & Crystals LLC, Today Tomorrow Forever Rescue, their respective agents, employees, owners, and independent contractors, along with their sureties, insurers, successors, assigns, and legal representatives, from any liability, claim, cause of action, demand, or damages for injury, death, or damages of any kind to any person or their property resulting from any actual or claimed intentional or wrongful act or omission by me arising from or as a result of my presence at Cats & Crystals or my participation in any activities there. I agree to provide this defense and indemnity regardless of the merit of the claim.
I bind my heirs, executors, assigns, and all other legal representatives by signing this Release.
I acknowledge and agree that this Release is intended to be construed and interpreted as broad and inclusive as permitted by the laws of the District of San Diego County. If any part of this Release is found or declared to be invalid or unenforceable, such invalidity shall not affect the remainder of this Release, and the unaffected portions shall remain in full force and effect. This Agreement is governed by the laws of the District of San Diego County, irrespective of any conflicting laws that might be applicable under principles of conflicts of law, and regardless of the jurisdiction in which any legal action or special proceedings may be initiated. All disputes shall be litigated exclusively within the courts of the San Diego County, and I submit to the jurisdiction of the aforementioned court.
By signing this Release, I confirm that I have read and understood its contents, have been advised and had the opportunity to seek independent counsel of my choice, and certify that I have freely and voluntarily executed this Release. I acknowledge that, without executing this Release and agreeing to its terms, Cats & Crystals would not permit me to participate in any activities at Cats & Crystals.
